Welcome to the mclaughlin.com discussion area, a bulletin board for discussions about The McLaughlin Group and related topics.

In an effort to ensure that all users of the discussion area both enjoy and benefit from discussions on the discussion area, you must abide by both the User Agreement, which you must read and agree to before using any part of the mclaughlin.com (“TMG”) web site (the “Site”), and the rules set forth below. The TMG Site is owned and operated by Oliver Productions, Inc., which has established the User Agreement and the rules set forth below. Please read them carefully. If you do not wish to abide by the User Agreement or these rules, please refrain from using the discussion area.

Abiding by the following rules is a prerequisite for the use of the discussion area. By using the discussion area, you signify your consent to these rules. These rules complement, but do not replace, diminish, or amend the provisions of the User Agreement. In the event of any discrepancies between these rules and the User Agreement, the User Agreement controls.
Rules Governing Use of the Discussion Area

1. By using the discussion area, you expressly consent to follow these rules.

2. Please focus on the topic or topics being discussed; if you stray to other topics, your message may be removed without notice. Other messages may be removed without notice for failure to abide by these rules or the User Agreement.

3. Please do not threaten, harass, defame, libel, or otherwise injure or risk injury to other participants through your words or otherwise; do not use “hate words” such as those that merely offend and do not add to the debate or discussion.

4. Although postings to the discussion area are normally monitored, we are not responsible for and assume no liability for the content of any postings or for any errors, inaccuracies, defamation, libel, slander, omissions, falsehoods, obscenity, pornography, or profanity that may be posted. Nor are we responsible in any way for any personal information you may choose to post. If you use the Site, you are responsible for maintaining the confidentiality of any of your personal information and for restricting access to your computer, and you agree to accept responsibility for all activities that you engage in. Please do not post or transmit any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic or profane material or any material that is invasive of privacy, infringing of intellectual property rights, that may be considered a criminal or civil offense, or that violates any law. Opinions expressed by you and others in the discussion area are solely those of the individuals posting, and not of Oliver Productions. We will fully cooperate with any law enforcement authorities or court inquiring into any posting to the Site.

5. Please do not manipulate the discussion group to as to make it impossible or difficult for others to enjoy it; this includes any effort to post a text format that is unreadable or that makes other postings unreadable.

6. The Site is for your noncommercial use, and any use of the Site or the discussion area to disseminate commercial material or otherwise perform solicitations is strictly prohibited.

7. Harvesting or otherwise collecting names, email addresses, or other identifying information from participants is also strictly prohibited, although, again, we are not responsible for and assume no liability for such matters.

8. If Oliver Productions determines that you are engaging or have engaged in any inappropriate behavior, including, but not limited to, a violation of these rules or the User Agreement, we reserve the right to terminate your participation in the discussion area without notice. Because we cannot detect all violations, however, Oliver Productions is not responsible or liable for the behavior of the participants to the discussion area and has and assumes no liability to any participant in the discussion area. Participants use the discussion area at their own risk and assume the risk of any related injury or damage. This includes, but is not limited to, any and all direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, the discussion area and/or the Site.

9. Postings to the discussion area are not confidential, and any communication through or with the Site, including postings to the discussion area, automatically and immediately becomes the property of Oliver Productions. To the extent that Oliver Productions does not retain exclusive ownership of such communications, Oliver Productions retains a non-exclusive license in such communications. These rights of Oliver Productions are royalty-free, perpetual, irrevocable, and fully sublicensable. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate these rules or the User Agreement and will not cause injury to any person or entity; and that you will indemnify Oliver Productions, Inc. and its officers, directors, employees, agents, servants, and affiliates for all claims resulting from content you supply. Any such communications may be quoted on The McLaughlin Group television program, McLaughlin’s One-On-One, or any other Oliver Productions broadcast or publication of any kind throughout the world in any media without notice. Oliver Productions may, for any reason or for no reason, excerpt, modify, adapt, translate, use, distribute, publish, display, create derivative works from, or sell these communications in any way Oliver Productions chooses, in its sole subjective discretion, without liability.

10. Oliver Productions reserves the right to change these rules at any time, and by using the discussion area you agree to be bound by such changes. If any of these rules shall be deemed invalid, void, or for any reason unenforceable, the rule(s) in question shall be deemed severable and shall not affect the validity and enforceability of any remaining rules.

11. These rules are governed by the laws of the District of Columbia, without regard to any applicable conflict of laws or principles, and in the event of any disputes arising out of these rules or the use of the discussion area, District of Columbia law will apply and any user’s home office will be deemed to be located in the District of Columbia. The exclusive venue for determination of any disputes arising under the rules or out of the use of the Site or the discussion area shall be the District of Columbia.
